Governance Policies

The Global Fund is a Foundation registered under Swiss law, though it enjoys unique legal status and recognition in Switzerland as a result of its public character and purpose. The Government of Switzerland has entered into a Headquarters Agreement (available in French and English) with the Global Fund which recognizes it as an international legal personality, and grants it certain legal privileges and immunities similar to those granted to intergovernmental organizations.

The Fund’s operations and structures are guided by the Framework Document (see below) issued by the Transitional Working Group, the negotiating body which met in Brussels in the fall of 2001 to establish the operating structure and principles of the Fund.

The primary governance policies and procedures of the Global Fund are set out in its Bylaws and Board Operating Procedures available below in both English and French. Other governance policies and procedures are set out in specific Board Decisions and Board-approved policies. The most important of these policies are set out in the table below.
